This is MACC Care Ltd Privacy Notice.

As part of the services we offer, we are required to process personal data about our service users and in some instances, the friends or relatives of our service users. “Processing” can mean collecting, recording, organising, storing, sharing or destroying data.

We are committed in providing transparent information as to why we need your personal data and what we do with it. It will also explain your rights when it comes to your data. This information is set out in this privacy notice.

Service Users

What data do we have?

In order to provide a safe and professional service, we must keep certain records about you. We may record the following:

  • Your basic details and contact information e.g. your name, address, date of birth and next of kin;
  • Your financial details e.g. details of how you pay us for your care or your funding arrangements.

We also record the following data which is classified as “special category”:

  • Your health and social care information, which might include both: your physical & mental health data.
  • Information, such as your race, ethnic origin, sexual orientation or religion.

Why do we keep this data?

We require this data so that we can provide a high quality care and support. By law, we need to have a lawful basis for processing your personal data.

We process your data, for the reason that:

  • We are required to do so in our performance of a public task;
  • We are required to do so in order to fulfil a contract that we have with you;
  • We have a legal responsibility to operate under the Health and Social Care Act 2012 as well as the Mental Capacity Act 2005.

We process your special category data because;

  • It is necessary due to social security and social protection law (generally this would be in instances of safeguarding);
  • It is necessary for us to provide and manage social care services;
  • We are required to provide data to our regulator, the Care Quality Commission (CQC), as part of our public interest obligations.

We may also process your data with your consent. If we need to ask for your permission, we will offer you a clear choice and ask that you confirm to us that you consent. We will also explain to you clearly as to why we need the data and how you can withdraw your consent.

Where do we process your data?

In order for us to be able to provide you with a high quality care and support, we will need to obtain a specific data. Such data is collected from, or shared with:

  1. You or your legal representative(s);
  2. Third parties.

We do this either by face to face, phone, email, MACC Care website or post.

Third parties are organisations whereby we have a legal reason to share your data with. These include:

  • Other parts of the health and care system such as local hospitals, the GP, the pharmacy, social workers, clinical commissioning groups, and other health and care professionals;
  • The Local Authority;
  • Organisations we have a legal obligation to share information with i.e. for safeguarding, the CQC;
  • The police or other enforcement agencies, if ordered by law or court order.

What data do we have?

As part of our work providing high-quality care and support, it might be necessary that we hold the following information about you:

  • Your basic details and contact information e.g. your name and address;

Why do we have this data?

By law, we need to have a lawful basis for processing your personal data.

We process your data as we have a legitimate business interest in holding next of kin and lasting power of attorney information about the individuals who use our service and keeping emergency contact details for our residents.

We may also process your data with your consent. If we need to ask for your permission, we will offer you a clear choice and ask that you confirm to us that you consent. We will also explain to you clearly as to why we need the data and how you can withdraw your consent.

How information is retained and kept safe?

Information is retained in secure electronic and paper records and access is restricted to only those who authorised to know.

It is important that information is kept safe and secure, to protect your confidentiality.  There are a number of ways in which your privacy is shielded; by removing your identifying information, using an independent review process, adhering to strict contractual conditions and ensuring strict sharing or processing agreements are in place.

The Data Protection Act 1998 and EU GDPR 2018 act regulates the processing of personal information.  Strict principles govern our use of information and our duty to ensure it is kept safe and secure.  MACC Care ltd is registered with the Information Commissioners Office (ICO).

Technology allows us to protect information in a number of ways, mainly by restricting access.  Our guiding principle is that we hold your information in strict confidence.

How do we keep information confidential?

Everyone working for MACC Care ltd is subject to the Common Law Duty of Confidentiality and the Data Protection Act 1998 together with EU GDPR 2018 act.  Information provided in confidence will only be used for the purposes to which you consent to, unless there are other circumstances covered by the law.

Under the MACC Care ltd Confidentiality Code of Conduct, all staff are required to protect information, inform you of how your information will be used and allow you to decide if and how your information can be shared which will be noted within your records.

Also, all MACC Care Ltd employees are required to undertake training in data protection, confidentiality, IT/cyber security, with additional training for specialist, such as healthcare records, data protection officers and IT staff.

Know Your Rights

The data that we keep about you is your data and we ensure that we keep it confidential and that it is used appropriately. You have the following rights when it comes to your data:

  1. You have the right to request a copy of all of the data we keep about you.
  2. You have the right to ask us to correct any data we have which you believe to be inaccurate. You can also request that we restrict processing all your data while we consider your rectification request;
  3. You have the right to request that we erase any of your personal data which is no longer necessary for the purpose we originally collected it for. We retain our data in line with the MACC Care Ltd and CQC Guidelines
  4. You may also request us to restrict processing your personal data if we no longer require for the purpose we originally collected it for, but you do not wish for that data to be erased.
  5. You can ask for your data to be erased if we have asked for your consent to process your data. You can withdraw consent at any time – please contact us to do so.
  6. If we are processing your data as part of our legitimate interests as an organisation or in order to complete a task in public interest, you have the right to object to that processing. We will restrict all processing of this data while we look into your objection.

If you would like to make a data request you can write, email or call our Data Protection Officer, Carol Sabell. You may be asked to provide adequate information to our team to be able to identify you, for example a passport or driver’s licence and this is to ensure your data is not shared with the wrong person. We will always endeavour to respond to your request as soon as possible and at the latest within one month.

MACC Care Group  – Modern Slavery Statement 2021

This statement sets out the steps that MACC Care Group has taken and is continuing to take to ensure that modern slavery or human trafficking is not taking place within our business or supply chain.

Modern slavery encompasses slavery, servitude, human trafficking and forced labour. MACC Care Group has a zero-tolerance approach to any form of modern slavery and human trafficking. We are committed to acting ethically and with integrity and transparency in all business dealings and to putting effective systems and controls in place to safeguard against any form of modern slavery taking place within the business or our supply chains.

MACC Care Group is a leading group of care homes, in and around Birmingham and Wolverhampton (West Midlands). We currently have 13 care homes within the MACC Care group; Abbey Rose, Austin Rose, Blossomfield Rose, Blythe Rose, Church Rose, Dora Rose, Meadow Rose, Priestley Rose, Sutton Rose, Studley Rose, Watermead Rose, Willow Rose and Wulfrun Rose. All MACC Care homes are recognised by the CQC and are providers of high-quality nursing under the NHS continuing healthcare framework. We work in partnership with NHS and employ 750 employees.

MACC Care Group implements its business strategy in an ethically, socially and environmentally responsible manner. We fully acknowledge our responsibility to respect human rights as set out in the International Bill of Human Rights. The IBHR informs all of our policies related to the rights and freedoms of every individual who works for us, either as a direct employee, agency worker or indirectly through our supply chain. We are also committed to implementing the United Nations Guiding Principles on Business and Human Rights throughout our operations. Respect for the dignity of the individual – and the importance of each individual’s human rights – form the basis of the behaviours we expect in every workplace nationally.

We will not accept any form of discrimination, harassment or bullying and we require all of our managers to implement policies designed to increase equality of opportunity and inclusion for all employees including agency workers. We have also developed and implemented policies and processes which are intended to extend these commitments through our supply chain.

Policies

We have several internal policies to ensure that we are conducting business ethically and transparently. These include:

• Human Rights policy and our Ethics Policy where we confirm that we will not tolerate or condone the abuse of human rights within any part of our business or supply chains and will take seriously any allegations that human rights are not properly respected

• Whistleblowing Policy, aimed principally at our employees but also available to others working in our supply chains which encourages staff to report any wrongdoing which extends to human rights violations like Modern Slavery. All reports will be fully investigated and appropriate remedial actions are taken and we will work closely with social care and health providers ensuring that our policies and procedures dovetail with local procedures and best practice

• A robust recruitment policy, including conducting eligibility to work in the UK checks for all employees to safeguard

• Employee Code of Conduct consistent with any professional codes of conduct

Direct Communication

The Company encourages members of the public or people not employed by us to write, in confidence, to raise any concern, issue or suspicion of modern slavery in any part of our business.

Suppliers

Our supply chains relate to the provision of maintenance services, the procurement of food and beverages,

The engagement of temporary and agency staff and covering utilities and waste management. Our antislavery policy forms part of our agreement with suppliers. We expect high standards of all our suppliers and that they work to all relevant requirements under the Modern Slavery and Human Trafficking Act

We conduct due diligence on all suppliers before allowing them to become a preferred supplier. We include an online search to ensure that particular organisations have never been convicted of offences relating to modern slavery and we include our modern slavery policy as part of our contract with all suppliers. Suppliers are required to confirm that no part of their business operations contradicts this policy. As part of our contract with suppliers, they confirm to us that:

  1. They have taken steps to eradicate modern slavery within their business
  2. They hold their suppliers to account over modern slavery
  3. For UK based suppliers, they pay their employees at least the national minimum wage/national living wage (as appropriate) and to ensure that within their supply chains, where UK based suppliers have overseas supply chains, that their employees’ pay is consistent with their national minimum wage requirements, working conditions are safe and fair, there is no child labour and working hours are not excessive
  4. We may terminate the contract at any time should any instances of modern slavery come to light

Risk Assessments

Our supply chains include procurement of staff, consumables, facilities maintenance, utilities and waste management. We have conducted a risk assessment and will ensure that we will take further steps to ensure that we support the eradication of modern slavery, that staff understand how to recognise modern slavery and the appropriate safeguarding reporting processes are followed should there be concerns within our supply chains, with customers or suppliers.

Performance indicators

We will know the effectiveness of the steps that we are taking to ensure that slavery is not taking place within our business or supply chain if:

  • No reports are received from employees, the public, or law enforcement agencies or local safeguarding teams to indicate that modern slavery practices have been identified

Safeguards

We aim to encourage openness and will support anyone who raises genuine concerns in good faith under this policy, even if they turn out to be mistaken. We are committed to ensuring that no one suffers any detrimental treatment as a result of reporting in good faith their suspicion that modern slavery of whatever form is or may be taking place in any part of our business. Detrimental treatment includes dismissal, disciplinary action, threats or other unfavourable treatment connected with raising a concern. MACC Care Group will accept and take seriously concerns communicated anonymously. However, retention of anonymity does render investigations and makes validation more difficult and can make the process less effective. Individuals are therefore encouraged to put their names to allegations. Any claims or allegations made which are found to be malicious or vexatious will result in disciplinary action being taken against the individual.

Responsibility for this Statement

The ultimate responsibility for the prevention of modern slavery rests with the Sharen Guise (Operation Director) for ensuring that this policy and its implementation complies with our legal and ethical obligations. Managers at all levels are responsible for ensuring that those reporting to them understand and comply with this policy and are given adequate and regular training on it and the issue of modern slavery.

Assessment of effectiveness in preventing Modern Slavery

We understand that modern slavery risk is not static and will continue our approach to mitigating this risk. We will assess the risk via our internal auditing processes.

This statement is made according to section 54(1) of the Modern Slavery Act 2015 and constitutes the modern slavery and human trafficking statement of MACC Care Group for the financial year ending 2022. Sharen Guise (Operation Director) of MACC Care Group has approved this statement.
